Virtual Battery Terms & Conditions

Effective: 1 May 2026

These Terms and Conditions apply to the Virtual Battery promotional offer provided by Green ESS in partnership with Fig Energy. These Terms and Conditions govern eligibility for the offer, how the offer operates, and the circumstances in which the offer may commence, vary, or end.

1. Promoter

The Virtual Battery offer is provided by Green ESS in partnership with Fig Energy.

The Virtual Battery offer is available from 1 May 2026.

This offer is initially available in Victoria only, and only within eligible areas serviced by Fig Energy.

4. Eligibility

To be eligible for this offer, customers must:

• purchase a new GreenVolt Pro system from Green ESS

• be located within an eligible Fig Energy service area

• sign up to a qualifying Fig Energy electricity plan that is marked as supporting Virtual Battery

• continue to maintain an eligible Fig Energy Virtual Battery plan for the duration of the offer

• satisfy any installation, technical, and grid connection requirements as determined by Green ESS and/or Fig Energy

• have an existing solar PV system at the property, or install solar PV together with the new GreenVolt Pro system through Green ESS

This offer is not available to existing GreenVolt Pro customers unless otherwise approved by Green ESS in writing.

4.1 Life Support Customers

Customers who have a registered life support machine at their property should contact Fig Energy before applying for this offer. Special conditions may apply. This offer does not affect any protections available to life support customers under applicable energy laws and regulations.

5. Grid Connection Requirement

Participation in the Virtual Battery offer is subject to Fig Energy confirming that the relevant property can be connected and supplied under an eligible Fig Energy Virtual Battery plan.

If Fig Energy determines that the property cannot be connected, or is otherwise unsuitable for an eligible Fig Energy Virtual Battery plan, the Virtual Battery benefit will not apply.

6. How the Offer Works

Under this offer, Green ESS will fund a daily electricity allowance for eligible customers through Fig Energy.

The allowance applies only to eligible electricity purchased from the grid through Fig Energy under a qualifying Fig Energy Virtual Battery plan.

The amount of the daily allowance is linked to the installed GreenVolt Pro battery capacity, subject to the limits set out in these Terms and Conditions.

7. Daily Electricity Allowance

Eligible customers may receive a daily electricity allowance based on the purchased GreenVolt Pro battery capacity, subject to a maximum of 25 kWh per day.

In all cases, the combined total of the installed GreenVolt Pro battery capacity and the Virtual Battery allowance must not exceed 50 kWh.

Examples:

• 15 kWh GreenVolt Pro battery = up to 15 kWh daily electricity allowance

• 25 kWh GreenVolt Pro battery = up to 25 kWh daily electricity allowance

• 30 kWh GreenVolt Pro battery = up to 20 kWh daily electricity allowance

• 40 kWh GreenVolt Pro battery = up to 10 kWh daily electricity allowance

8. Daily Cap Rules

The daily electricity allowance:

• is a daily cap

• resets on each calendar day

• expires if unused at midnight on that calendar day

• cannot be rolled over or accumulated

• applies only to eligible electricity purchased from the grid through Fig Energy

Unused daily allowance has no cash value and cannot be transferred, refunded, exchanged, redeemed for cash, or converted into account credit unless otherwise stated by Green ESS.

9. Benefit Commencement

The Virtual Battery benefit will commence only after:

• the relevant GreenVolt Pro installation has been completed

• Fig Energy has confirmed grid connection

• the customer's first billing day has commenced under the qualifying Fig Energy Virtual Battery plan

No Virtual Battery benefit applies before all of the above conditions have been satisfied.

10. Offer Duration

This offer is subject to availability and program terms.

For customers who successfully join the program, the benefit may continue while the customer remains on an eligible Fig Energy Virtual Battery plan, until 31 December 2030, subject to program terms. Green ESS will provide customers with reasonable notice if the program end date changes.

11. Limited Availability

This is a limited offer. Green ESS reserves the right to determine, at its discretion:

• the number of places available

• when the offer opens or closes

• whether the offer remains available in any region, for any particular product, installation type, or customer category

Participation is subject to availability and final approval by Green ESS.

Where Green ESS proposes to make any material change to this offer that affects existing participants, Green ESS will provide at least 14 days written notice to affected customers, except where required by law or necessary to address fraud or misuse.

12. Circumstances Where the Benefit May End

The Virtual Battery benefit may end immediately if:

• the customer cancels or changes from the eligible Fig Energy Virtual Battery plan

• the customer moves to an address outside an eligible Fig Energy service area

• the customer's property or account is no longer eligible for Fig Energy supply under a qualifying plan

• the customer no longer meets the eligibility requirements for the offer

• the relevant GreenVolt Pro system is disconnected, removed, decommissioned, or otherwise becomes ineligible

• Fig Energy determines that the customer cannot continue to be supplied under an eligible plan

• Green ESS or Fig Energy determines that the customer has breached these Terms and Conditions

• the program is varied, suspended, withdrawn, or ended by Green ESS in accordance with these Terms and Conditions

13. Changes to the Offer

Green ESS reserves the right, at any time, to amend these Terms and Conditions, change the structure of the offer, vary eligibility criteria, vary allowance calculations, change or remove qualifying products or regions, or suspend, withdraw, or terminate the offer.

Any such changes will apply subject to applicable law. Where a material change affects existing participants, Green ESS will provide at least 14 days written notice, except where required by law or necessary to address fraud or misuse.

14. No Government Affiliation

The Virtual Battery offer is a promotional commercial offer provided by Green ESS in partnership with Fig Energy. It is not a government rebate, government subsidy, or government-run program, and is separate from any STC, state rebate, or other government incentive.

15. No Guarantee of Savings

Actual customer value, benefit, bill outcomes, and electricity usage outcomes will vary depending on factors including electricity consumption, tariff structure, billing cycle usage, selected Fig Energy plan, GreenVolt Pro battery size, grid usage behaviour, eligibility status, and technical and connection conditions.

Green ESS does not guarantee any particular level of savings, bill reduction, financial outcome, or electricity usage result unless expressly stated otherwise in writing.

16. Limitation of Liability

To the maximum extent permitted by law, Green ESS and Fig Energy will not be liable for any indirect, consequential, or economic loss arising out of or in connection with this offer, including any loss of anticipated savings or benefits.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies that customers may have under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded, restricted, or modified.

17. Pricing Comparisons in Marketing

Any pricing or capacity comparisons used in Green ESS promotional materials are illustrative only and are based on the pricing assumptions stated in those materials. Unless otherwise stated, any comparison referring to battery size or budget impact is based on GreenVolt Pro battery-only pricing, including GST and installation, using applicable Victorian rebate-adjusted pricing.

18. Personal Information

To enquire about or participate in this offer, customers may be required to provide personal information, including name, phone number, email address, address, and installation-related information.

Green ESS and Fig Energy may collect, use, and share this information where reasonably necessary for the purposes of assessing installation and grid connection suitability, assessing eligibility, administering the offer, and contacting the customer regarding the offer.

The collection and handling of personal information is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy is available at www.greeness.com.au/privacy. Customers have the right to access and request correction of their personal information by contacting Green ESS.

19. Information Sharing

By submitting an enquiry or application, the customer acknowledges and agrees that their information may be shared between Green ESS and Fig Energy where reasonably necessary to assess eligibility, installation suitability, grid connection, and program administration.

20. Marketing Communications

Green ESS and/or Fig Energy may send customers updates directly related to the Virtual Battery offer and their participation in it.

Customers who wish to receive additional promotional or marketing communications from Green ESS and/or Fig Energy may opt in separately. Customers may opt out of marketing communications at any time by contacting us or using the unsubscribe link in any communication.

22. General

This offer cannot be transferred, assigned, substituted, or exchanged for cash, is subject to availability and final approval by Green ESS, and may be refused, cancelled, or reversed where Green ESS reasonably believes the offer is being misused or used contrary to these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

23. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria.

24. Governing Version

In the event of any inconsistency between promotional materials, FAQs, sales communications, and these Terms and Conditions, these Terms and Conditions prevail to the extent of the inconsistency.
